Contest Rules and Legal Disclaimers:
Contestants agree to all terms and legal disclaimers regarding this contest, and by the decisions of the Sponsors (ChapalaDream.com) and judges, which are final and binding on all matters pertaining to the contest.

Contest Summary: This is a skill contest whereby individuals choosing to participate pay an $85.00USD contest entry fee, and submit a written essay of 100 words or less per entry. All entries must be the creation of the contestant, unique for this contest, and must not infringe upon the rights of any other person or entity. There is no element of chance. The prize is a family home in Chapala, Jalisco, Mexico if the target number of 10,000 eligible entries is received. An additional prize of $25,000.00USD will be awarded to the qualified entrant who refers the most eligible participants if over 10,500 qualified entries are received. Should the minimum target number of 10,000 eligible entries not be received, a cash prize will be awarded in its place.

Eligibility:
To be eligible to win, a contestant must be at least 18 years of age, pay the $85.00USD entry fee, be legally eligible to own property located in Mexico, and agree to comply with these Official Rules and Regulations. This contest is open to all individuals world-wide, organizations and/or investors, and is void wherever prohibited by law. The Sponsors and judges of the Contest, as well as those individuals’ immediate family members and the residents of their households, are not eligible. The Sponsors reserve the right, exercisable upon their sole discretion, to disqualify any individual they find has: (1) violated the Official Rules and Regulations; (2) interfered with, or attempted to manipulate, the Contest or Contest results; (3) violated any law or regulation by participating in the Contest; or (4) provided false information to the Sponsors. By entering the ChaplaDream.com questions and essay contest, contestants consent to be bound by these Official Rules and Regulations, which shall constitute a contract between entrants and the Sponsors. All decisions of the Sponsors, with respect to the ChapalaDream.com contest, shall be final.

Eligible individuals may enter the Contest by submitting a qualified, online entry at ChapalaDream.com during the Contest Period. An individual may enter as many times as he/she desires so long as each submission satisfies the entry requirements. The prize will be awarded only to the name(s) submitted upon the winning entry form. No more than two names may be on the entry form. If an entry is, in fact, the result of more than one individual, the Sponsors are only responsible for the title and transfer fees for no more than two (2) individuals. The Sponsors are not responsible for any disputes that may arise between participants of one entry form. To qualify for entry into the Contest, all participants must complete an essay question in 100 words or less, answer whether or not they were a referral for the $25,000.00 drawing (to be held only if more than 10,500 qualified entries are received) and submit their payment through PayPal. Due to the delays in mail and excessive costs involved with receiving above normal quantities of mail in Mexico, it is impossible to accept entries by mail.

The Judges:
There will be a minimum of 3 impartial and independent judges with one vote each, for a total of 3 (or more) votes. The entries will be judged based on answers to the 100 words or less essay question. This is a contest of “skill” and there are no “odds” of a particular entry being chosen by the judges.

Contest Period.
The Contest shall begin 12:00p.m. (Midnight) Central Standard Time, 1 September 2009, and end at 11:59 pm Central Standard Time, 28 February 2010, (“Contest Period”). All entries must be received on or before 11:59 pm Central Standard Time, 28 February 2010 unless extended or shortened by the Sponsors in accordance with these rules. The Contest Period may be extended for a period of up to 90 additional days in the event that the end of the Contest Period does not meet the minimum Entrant Number Amount (10,000 minimum); however, should the volume of entries be such that extra time is needed to properly process them, then the contest ending date will be extended up to 90 additional days, although no further entries will be accepted. Entries received after the Contest Period will not be considered. If the minimum entrant number amount is not met, the Sponsors will award a cash prize to the winning entry.

Prizes
Grand prize is a clean title to the residence located in Chapala, Jalisco, Mexico, as described in the legal description in the existing title. All normal closing costs will also be covered by the Sponsors of the Contest for proper legal process and related mailing fees for signatures related to the legal transfer of the property. The winner will be responsible for his/her own transportation and hotel expenses related to attending the closing and any and all federal, state, local or other taxes associated with the prize awarded, if any due, in their country of origin. The transfer of the residence located in Chapala, Jalisco, Mexico will be awarded on or before two (2) months following the end of the Contest Period unless changed, in writing, by both the winner and the Sponsors. The exact transfer date of the property will be set by the notario (the legal title processor in Mexico). The residence is awarded “AS IS” and WITHOUT WARRANTY OF ANY KIND BY THE SPONSORS OR ANY OTHER PERSON, expressed or implied, (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose.) Except where prohibited by law, the winner must execute and provide to the Sponsors the following: 1) Affidavit of Eligibility, attesting to the winner’s eligibility and compliance with the Official Rules and Regulations; 2) A Liability Release, releasing the Sponsors from any liability arising out of the Contest; 3) A Publicity Release, allowing the Sponsors to use the winner’s name, likeness, voice and biographical information for publicity purposes. The winner will also be required to provide any other information needed by the Sponsors to comply with applicable laws and regulations, including those relating to income taxes or any other taxes associated with the prize awarded, if any due, in their country of origin. By accepting a prize, the winner grants the Sponsors permission for the use of his/her name, likeness and biographical information for advertising and promotional purposes without additional compensation.

An additional cash prize of $25,000.00 USD will be awarded in a separate contest if the ChapalaDream.com Contest eligible entries exceed 10,500. The eligible contestants who have referred another eligible entrant (who has met all entry requirements) will have their names entered with each referral. The entrant with the most qualified referrals will be awarded the $25,000.00USD cash prize. If there is a tie, the winner will be chosen based upon his/her answer to the essay question. The $25,000.00 USD cash prize will be received by the winner on or before 60 days following the end of the Contest Period. All federal, state, local, or other taxes, if any due in his/her country of origin, are the sole responsibility of the prize winner. Except where prohibited by law, the winner of the $25,000.00 USD cash prize must execute and provide to the Sponsors the following: 1) Affidavit of Eligibility, attesting to the winner’s eligibility and compliance with the Official Rules and Regulations; 2) A Liability Release, releasing the Sponsors from any liability arising out of the Contest; 3) A Publicity Release, allowing the Sponsors to use the winner’s name, likeness, voice and biographical information for publicity purposes. The winner will also be required to provide any other information needed by the Sponsors to comply with applicable laws and regulations, including those relating to income taxes. By accepting a prize, the winner grants the Sponsors permission for the use of his/her name, likeness and biographical information for advertising and promotional purposes without additional compensation.

Prize Notification
The winner(s) will be notified in one of the following ways: phone, email, in person, on the website, or in writing by overnight courier within 10 days of the prize being awarded. If the Sponsors are unable to confirm the winner(s) within 14 days of notification being sent, or if a winner is disqualified, then the prize will be forfeited and awarded to the next best entry. The name(s) of the winner(s) will be posted on www.ChapalaDream.com.

As a condition of awarding the prize(s), the potential winner(s) is (are) required to sign notarized affidavits of eligibility, publicity and liability release and return them properly executed within 10 business days from the date the potential winner is notified. If a potential winner fails to return the affidavits as specified, that potential winner will be disqualified and an alternate winner may be selected.

Current Occupants are allowed up to 45 days to vacate the home, from the date the affidavits are executed and received by ChapalaDream.com.

The Sponsors have made every effort to display the prize(s) as accurately as possible. Please note, however, that the colors used, as well as the display and color capabilities of each particular computer monitor, will greatly affect the colors actually seen on the screen. The site cannot be responsible for the limitations of each individual monitor’s display of color, texture, or detail of the images included of the prize. The documents and related graphics published on this server could also include technical inaccuracies or typographical errors.

Copyright Ownership and License
Each contestant’s name, city, state and contact information are non-confidential for the purposes of this contest. The Sponsors may disclose this information in conjunction with announcements related to the prize winner(s) and the contest. By participating, each contestant further agrees that such submissions, of his/her completed entry shall become the sole property of the Sponsors and that all title and interest shall rest with the Sponsors at the time they are submitted.

Governing Law
The Sponsors control this site. This site can be accessed from countries around the world. As each of these jurisdictions has laws and regulations that may differ from those of Mexico, by accessing this site both the contestants and the Sponsors agree that the statutes and laws of Mexico, without regard to conflicts of laws principles thereof, will apply to the Contest, including any legal proceeding arising there from. In the case of a dispute, the contestants and the Sponsors agree any litigation arising between the parties hereto shall be brought only in the Mexican state or federal court having subject matter jurisdiction in Chapala, Jalisco, Mexico. By participating in this contest, contestants have irrevocably and unconditionally consented to the jurisdiction of any such court and hereby irrevocably and unconditionally waive any defense of an inconvenient forum to the maintenance of any action or proceeding in any such court, any objection to venue with respect to any such action or proceeding, and to any right of jurisdiction on account of the place of residence or domicile of any party thereto.

Limitations of Liability
In no event will the Sponsors, the judges, their representatives or agents, immediate family, members or residents of their households, their affiliates or employees and partners, the Sponsors’ web designer or their respective officers, directors, employees, representatives or agents, immediate family members or residents of their households be responsible or liable for any damages or losses of any kind, including direct, indirect, incidental, consequential, statutory or punitive damages. Without limiting the foregoing, with respect to the Contest and to the Prize(s), the Sponsors make no warranty of any kind, either express or implied, including, but not limited to, the implied warranties or merchantability of fitness for a particular purpose. Some jurisdictions may not allow the limitations or exclusion of liability for incidental or consequential damages or exclusion of implied warranties so some of the above limitations or exclusions may not apply to you. Check local laws for any restrictions or limitations regarding these limitations or exclusions.

Amendment of Rules
The Sponsors may amend the Official Rules at their sole discretion. Amendments will be posted on the Sponsors’ website. Unless otherwise specified, any amendments will become effective on the day they are posted on this site.

Other Conditions, Rules, or Terms of Entry:
By entering this Contest, each contestant accepts and agrees to be bound by these Official Rules and Regulations and the decisions of the ChapalaDream.com sponsors and the Board of Judges. ChapalaDream.com and its agencies are not responsible for any incorrect or inaccurate information, whether caused by website users or by any of the equipment or programming associated with or utilized in the Contest or by any technical or human error which may occur in the processing of submissions in the Contest. ChapalaDream.com and its agencies assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of entries. ChapalaDream.com and its agencies are not responsible for any problems or technical malfunction of any telephone network or lines, computer systems, servers or providers, computer equipment or software on account of technical problems or traffic congestion on the Internet or combination thereof, including injury or damage to participants or to any other person’s computer related to or resulting from participating or downloading materials in this Contest. Submissions that are disqualified for not following the guidelines noted above will not be eligible for a refund of the entry fee. Any submission received incomplete may be voided and disqualified. Submissions are considered void if illegible, incomplete, irregular, pornographic, or obtained through fraud or theft. Any illegal activity or submission will be reported to the appropriate authorities.

The prize, the house in Chapala, Mexico, will be awarded fully furnished. The house will be awarded as is and without warranty of any kind, expressed or implied.

Winners will be responsible for any and all federal, state and local taxes associated with the prize awarded, if any due in their country of origin, and costs associated with the necessary travel to the to claim the prize. ChapalaDream.com is not a tax advisor and so cannot answer questions related to taxes, nor give any tax or legal advice. Questions related to taxes should be directed to a qualified tax advisor.

The Sponsors will be responsible for all fees associated with title transfer and all normal closing costs for proper legal process and related mailing fees for signatures related to the legal transfer of the property.

Entire Agreement
This Agreement, including exhibits (if any), contains all agreements between the Parties. Void where prohibited by law. There are no other representations, warranties, promises, agreements or understandings, oral, written or implied, among the Parties, except to the extent reference is made thereto in this Agreement.
